ABSTRACT

Although China has promulgated the “Inheritance Law” to solve the problems related to inheritance, the “Inheritance Law” only pays attention to the protection of the interests of heirs, but not creditors, so the protection of creditors' interests in inheritance has not been solved. The essence of inheritance notarization is to prove that the heir has the right to inherit the estate according to law, that is, the status of the estate after the occurrence of inheritance. The protection of creditors causes various problems under the condition of imperfect regulations. This paper puts forward some suggestions on the protection of creditors' interests from the aspect of perfecting the legal system.
