Analysis on Tort Liability of Generative Artificial Intelligence

ABSTRACT

This paper deeply discusses the application of generative artificial intelligence technology in modern society and its possible infringement and liability attribution issues. First, it analyzes the core characteristics of generative artificial intelligence, especially its ability in automatically generating content, and points out that while creating novel content, this technology may have the risk of infringing others' intellectual property rights. Then it discusses the definition of tort liability and the determination of liability subject according to different tort scenarios, and puts forward the liability distribution scheme in different situations, including the division of subjective fault liability and no-fault liability. In order to effectively manage these risks and protect the rights and interests of individuals and enterprises, it is necessary to establish a comprehensive management system and judicial standards, including perfect management norms, clear subjects of responsibility, and fair and efficient compensation and judicial mechanisms. Through these measures, we can maintain legal order and social justice while ensuring technological innovation, and promote the healthy and sustainable development of generative AI technology.
