ABSTRACT

Customary practices, as informal sources of law, play a significant role in influencing the development of statutory law. This paper examines the issue of the return of betrothal gifts in China, using this as a research perspective to analyze the conflicts and harmonization between customary practices and statutory law. By integrating relevant judicial practices, the study seeks to provide a comprehensive understanding of the interaction between these two sources of law. The findings aim to offer practical recommendations for improving the legal mechanisms for resolving disputes related to betrothal gifts, contributing to the enhancement of China's legal framework in this area.
