ABSTRACT
The advent of the Internet era has given birth to the vigorous development of the platform economy, and a number of new forms of employment, mainly net-sharing labour, have emerged, and this "de-labour relationship" mode of employment has also fallen into the gap of traditional dual framework theory in China. There is an urgent need for the law to make a clear identification of the nature of the net-sharing labour relationship, and to speed up the establishment of a mechanism to protect the rights and interests that match the demand of the net-sharing workers, to "untie" the protection content of some exclusive labour relations, to implement the principle of preferential protection, and to safeguard the legitimate rights and interests of workers.
